HIS HONOUR: In this matter Notice of Appeal was filed on the

9th of February 2007. The Notice of Address for Service was
filed later in February but no step has been taken since then

by the applicant to bring the matter on for hearing and so there has been, in view of the lapse of time since then, a failure to properly prosecute the appeal.	10
I am satisfied that a Notice of Intention - or notice of this
application was sent to the appellant - to the appellant's
address for service at least 10 days before the hearing of the
application so the appeal is struck out under section 229 of	20
the Justices Act.
