DAWSON J:   This matter was considered by Justices Gaudron, Gummow and myself.  The applicant seeks to challenge findings of fact made against him in relation to matters on which he bore the onus of proof.  The application does not raise any question of principle which would attract special leave to appeal.  Moreover, any appeal would not enjoy sufficient prospects of success to warrant special leave being granted.

Accordingly, the application for special leave is refused with costs.

AT 10.18 AM THE MATTER WAS CONCLUDED
