GLEESON CJ:   There is a certificate from the Senior Registrar to the effect that she has been informed by the solicitors for the respondents in this application that the respondents will not be appearing and will submit to any order of the Court in respect of the application for special leave to appeal, save as to an order for costs.

The Court has been informed that the Federal Court of Australia proposes, in the near future, to sit a specially constituted Full Court consisting of 5 members of the court for the purpose of dealing with issues, including the issues sought to be raised by the present applicants, and for the purpose of resolving some conflicts of opinion that have emerged between members of the Federal Court. 

In those circumstances, the Court is of the view that the appropriate course to take is to stand today’s application out of the list, to be relisted following the judgment of the specially constituted Full Court of the Federal Court to which I have referred.

We will now adjourn.
