LAND EXCHANGE.

No. 49 of 1934.

AN ACT to authorise an exchange of certain Land in re- serve A1720 (King's Park) 'for certain Land comprised in Swan location 3087 and held by the University of Western Australia and for other purposes relating to the said reserve.

Preamble.

HERE AS the University of Western Australia is the

Wregistered proprietor of certain land, being Swan

location 3087, adjacent to reserve A1720 (King's Park) : And whereas it is deemed desirable to improve and widen that

part of Winthrop avenue which adjoins reserve A 1720

(King's Park), and for that purpose it is necessary that cer- tain portions of the land in the said reserve be excised there- from; and whereas the said University desires a certain por- tion of the land comprised in the said reserve for University purposes, and, in consideration of such portion being excised from the said reserve and vested in the University, has of- fered in exchange portion of its said land in Swan location 3087 aforesaid: And whereas it is deemed desirable and ex- pedient that such exchange should be effected: Be it there- fore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative A ssembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title.

1. This Act may be cited as the King's Park and Univer- sity Land Exchange Act, 1934.

2. Subject as hereinafter provided, those portions of re- serve A1720 (King's Park) described in Parts I., II., and III.

of the First Schedule hereto are hereby excised from the said

reserve, and are dealt with as follows :—

University of

Western Australia.

(a)

the land described in Part I. of the First Schedule hereto shall. be and is hereby vested for an estate in fee simple in the University of Western Australia: and

(b)

the lands described in Part II. and Part III. respec- tively of the said First Schedule shall be and are here- by vested for an estate in fee simple in the city of Perth for the purpose of additions to Winthrop avenue aforesaid.

Provided that this section shall not take effect until the University of Western Australia shall have made to His Maj- esty the transfer and surrender of the land described in the Second Schedule to this Act.

FIRST SCHEDULE.

PART I.

All that portion of land, being part of reserve A1720 (King's Park) bounded by lines starting from a point on the northern alignment of the Perth-Fremantle road and situate 75deg. 19min. 1 chain 54-7/10 links from the junction of the eastern alignment of Winthrop avenue with the said northern alignment of Perth-Fremantle road, and extending 359deg. 32min. 9 chains 18-1/10 links to the southern alignment of Park road; thence along said southern alignment 75deg. 25min. 07-1/10 links; thence 165deg. Smin. 8 chains 89-8/10 links to the northern alignment of Perth-Fremantle road aforesaid, and thence along said northern alignment 255deg. 19min. 2 chains 95-4/10 links to the starting point.

All that portion of land, being part of reserve A1720 (King's Park) bounded by lines starting from the junction of the eastern alignment of Win- throp avenue with the northern alignment of the Perth-Fremantle road, and extending 359deg. 32min. 1 chain 54-7/10 links to the tangent point of a circular curve, the bearing and distance of the radius whereof is 89deg. 32min. 1 chain 20-4/10 links from said tangent point; thence by said curve south-easterly 2 chains 19 links to the tangent point situate on the northern alignment of Perth-Fremantle road aforesaid, and thence 255deg. 19min. 1 chain 54-7/10 links to the starting point.

PART III.

All that portion of land, being part of reserve A1720 (King's Park) bounded by lines starting from the intersection of the eastern alignment of Winthrop avenue with the southern alignment of Park road, and extending 75deg. 25inin. 1 chain 54-7/10 links to the tangent point of a circular curve, the bearing and distance of the radius whereof is 165deg. 25min. 1 chain 96-310 links from said tangent point; thence by said curve south-westerly 2 chains 62-7/10 links to the tangent point situate on the eastern alignment of Winthrop avenue aforesaid; and thence 359deg. 32min. 1 chain 54-7/10 links to the starting point.

All bearings being true or thereabouts and measurements more or less.

SECOND SCHEDULE.

All that portion of land, being part of Swan location 3087 bounded by lines starting from the junction of the southern alignment of Park road with the western alignment of Winthrop avenue, and extending 179deg. 34min. along the latter alignment 9 chains 37-9/19 links to the northern alignment of Stirling highway; thence 255deg. 20min. 1 chain 93-2.10 links to the tangent point of a circular curve, the bearing and distance of the radius whereof is 345deg. 20min. 2 chains 48-3/10 links from said tangent point; thence by said curve east-north-easterly 39-4j 10 links; thence 359deg. 34min. 9 chains 10-3/10 links to the southern alignment of Park road aforesaid, and thence 66deg. 59min. 1 chain 62-5/10 links to the starting point.

All bearings being true or thereabouts and measurements more or less.
