over cer ta in s t reets in the Borough of

K i a m a . [Uth April, 1883.]
WH E R E A S large of K i a m a A n d whereas for t h e purpose of faci l i ta t ing t h e carr iage of
quant i t i es of b lue me ta l a re be ing quarr ied a t
P ike ' s Hi l l and o ther places adjacent there to in t h e Borough

such b lue me ta l from the said quarr ies to Rober t son Basin for ship­ m e n t t h e Borough Counci l of K i a m a is desirous of cons t ruc t ing a

s ingle or double t r a m w a y for horse or s team t rac t ion a long and over
Ter ra!ong-s t ree t and o ther s treets and a reserve in t h e said Borough of
K i a m a A n d whereas such t r a m w a y cannot be made wi thou t Legis la­
t ive au tho r i t y A n d whereas t he increased facilities for traffic wh ich

would resu l t from t h e const ruct ion of t h e said proposed t r a m w a y would be for t h e pub l i c benefit and i t is desirable to au thor ize by Legis la t ive enac tmen t t h e const ruct ion of t h e said proposed t r a m w a y

subjec t to t h e provisions hereafter conta ined Be it therefore enacted

by t h e Queen ' s Most Exce l l en t Majes ty by and wi th t h e advice and consent of t he Legis la t ive Council and Legis la t ive Assembly of JNew Sou th W a l e s in Pa r l i amen t assembled and by t h e au thor i ty of t he same as fol lows. :—

1. I t shal l be lawful for t h e said B o r o u g h Counci l of K i a m a
upon t h e t e rms and condi t ions and subject to t he provisions here in­
after conta ined to m a k e a n d cons t ruc t a t r a m w a y for the ca r ry ing of

b lue m e t a l from t h e quarr ies a t P ike ' s H i l l and o ther places in t h e Borough of K i a m a along a n d over t h e streets and publ ic reserve described in t h e Schedule here to and to t ake and use so m u c h of t h e said s t reets and reserve as m a y be required for t h e purposes of such t r a m w a y and t h e traffic thereon b u t so t h a t t he same shal l no t occupy in any p a r t thereof a greater space in b r ead th t h a n nine feet i nc lud ing

t h e suppor t a n d foundations thereof.
2. The t r a m w a y where i t t raverses publ ic thoroughfares shal l

be laid a t abou t t h e general level of such thoroughfares and so t h a t

t he rails shall no t project above the surface thereof.

3. The t r a m w a y and the mate r ia l thereof shal l no t cease to be

t h e proper ty of t h e said Borough Counci l by reason of t h e same be ing

laid as aforesaid.

4. The said Borough Counci l a n d all o ther persons du ly au thor ­
ized shall have all necessary r igh ts over t h e streets and lands described

in t he Schedule to th is Ac t as are requi red for t h e cons t ruc t ion repair

complet ion and use of t he said t r a m w a y Provided t h a t t he re shall be
no in ter ference wi th o rd inary traffic beyond w h a t is reasonable a n d
necessary for such purpose .
5. The t r a m w a y shal l be for t h e use of persons engaged in t h e
b lue m e t a l i ndus t ry and for such other purposes as t he Borough Counci l
shall de te rmine and for t he use of t h e said t r a m w a y the Borough

Counci l shall he and are hereby empowered to charge a sum no t exceeding n inepencc per t on for each ton of b lue m e t a l or o ther

mate r ia l conveyed a long or upon the said t r a m w a y .
G. I t shall be lawful for the persons us ing the said t r a m w a y to

employ horses or o ther mot ive power and carriages waggons or t rucks to be d rawn the reby and to car ry upon t h e said t r a m w a y blue m e t a l or o ther ma te r i a l subject to charges Provided t h a t such charges shal l be a t all t imes levied equal ly on all persons and after t h e same ra t e i n respect to al l mater ia ls of t h e same description a n d no reduct ion or advance in any such charge shal l be made ei ther direct ly or indi rect ly in favour of or agains t any person us ing the said t r a m w a y .

7. The said charges shall be paid to such person or persons and a t such place or places upon or near t he said t r a m w a y and unde r such
regula t ions as the said Borough Council shall appoint .

8. I t shall be lawful for the said Borough Counci l to m a k e subjec t to the provisions of th is A c t regula t ions for t h e following purposes t h a t is to say—

F o r r egu l a t i ng t h e despatch of waggons and t r u c k s to and from

the place of sh ipment a n d the loading a n d un load ing thereof.

A n d general ly for r egu la t ing t he use and working of t h e said
t r a m w a y and the ma in tenaace of good order a n d t h e conduct
of persons employed in or abou t t h e said t r a m w a y and
providing for t he m a n a g e m e n t and pro tec t ion thereof.

9. I t shall be lawful for t he said Borough Counci l to borrow a s u m of money not exceeding five thousand pounds s ter l ing for t he m a k i n g of t he proposed t r a m w a y and for provid ing waggons or t r u c k s and the a m o u n t may be raised by debentures or o therwise on t h e secur i ty of t he revenue of the said Borough.

10. This A c t m a y be cited for all purposes as t he " K iama

T r a m w a y A c t of 1883 . "
