I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Kiama Local Environmental Plan 2011 (Amendment No 9).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the following land:

(a)

part of Lot 102, DP 775450, 105 Shoalhaven Street, Kiama,

(b)

Lot 208, DP 792192, 9 O’Connell Place, Gerringong,

(c)

certain land located at Pheasant Point Drive, Fitzroy Street, Devonshire Street, and Minnamurra Street, Kiama.

4      Maps

The maps adopted by Kiama Local Environmental Plan 2011 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

[1]      Schedule 1 Additional permitted uses

Insert after clause 7:

8      Use of certain land at Shoalhaven Street, Kiama

(1)

This clause applies to land at 105 Shoalhaven Street, Kiama, being part of Lot 102, DP 775450, identified as “8” on the Additional Permitted Uses Map.

(2)

Development for the purposes of a community facility is permitted with

development consent.

Omit “Nil” from Part 1. Insert instead:
