Application for approval of the Key To Specialists Pty Ltd Enterprise Agreement 2023
An application has been made pursuant to s 185 of the Fair Work Act 2009 (the Act) for the approval of a single enterprise agreement known as the Key To Specialists Pty Ltd Enterprise Agreement 2023 (Agreement).
I am satisfied that each of the requirements of ss 186, 187, 188 and 190 as are relevant to this application for approval have been met.
In relation to genuine agreement, I note the employees covered by the Agreement at the time of the vote was a numerically small group, and the Agreement has a coverage spanning many occupational classifications across disparate industries. However the voting cohort of employees each hold a range of professional expertise with at least 10 years of industry experience in various occupations covered by the Agreement and in each of the industries in which Agreement covered employees would work. Employees in these industries are covered by three modern awards, which are the reference awards for the purposes of assessing whether the Agreement passed the better off overall test, namely the Hyrocarbons Industry (Upstream) Award 2020, Building and Construction General On-Site Award 2020 and Mining Industry Award 2020.
The Agreement is approved and, in accordance with s 54 of the Act, will operate from 4 August 2023. The nominal expiry date of the Agreement is 28 July 2027.
