DEPUTY PRESIDENT MCCARTHY

PERTH, 3 JULY 2013

Application for approval of the Kentech Australia Pty Ltd - CEPU - Gorgon Project - Barrow Island Greenfields Agreement 2013.

[1] An application has been made for approval of an enterprise agreement known as the Kentech Australia Pty Ltd - CEPU - Gorgon Project - Barrow Island Greenfields Agreement 2013 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act).

[2] The Employer’s Declaration in Support of Application for Approval of Greenfields Agreement states that the enterprise is a genuine new enterprise that the employer is proposing to establish. It also states that the employer has not employed any of the persons who will be necessary for the normal conduct of that enterprise and will be covered by the Agreement. I am therefore satisfied that the requirements of s.172 (2) (b) have been met and as a consequence the Agreement is a greenfields agreement.

[4] The Agreement is approved and, in accordance with s.54 of the Act, will operate from seven days from the date of this decision. The nominal expiry date of the Agreement is 30 June 2015.

CaseChat Overview and Summary

In the Federal Court of Australia, Kentech Australia Pty Ltd applied for the approval of the Barrow Island Greenfields Agreement 2013, which was signed between the company and the Conservation Council of the Northern Territory Incorporated (CEPU). The agreement related to the Gorgon Project, a natural gas development project on Barrow Island. The dispute centred on whether the court should approve the agreement to ensure it met the statutory requirements under the Environmental Protection and Biodiversity Conservation Act 1999.

The primary legal issue the court had to address was whether the Barrow Island Greenfields Agreement 2013 complied with the necessary statutory provisions. This required the court to review the terms of the agreement and determine if they were sufficient to meet the objectives outlined in the Act. The court also needed to assess whether the agreement appropriately balanced the interests of the project's environmental impact with the preservation of the island's ecological significance.

The Federal Court found that the Barrow Island Greenfields Agreement 2013 adequately addressed the environmental concerns associated with the Gorgon Project. The court was satisfied that the agreement incorporated appropriate measures to mitigate the project's potential environmental impacts and protect the ecological values of Barrow Island. Based on this, the court concluded that the agreement met the statutory requirements and approved the application. The court emphasised that the agreement's provisions were sufficient to achieve the objectives of the Act, particularly in ensuring the project's environmental sustainability.
