CaseChat Overview and Summary
The primary legal issue the Commission had to resolve was whether the agreement met the requirements for approval under the Fair Work Act. This involved assessing whether the agreement provided for fair and reasonable terms and conditions for employees, and whether the agreement was certified as a genuine agreement by an independent person. The Commission also needed to consider the views of the parties involved and whether any party had raised objections to the agreement.
In its decision, the Commission examined the provisions of the proposed agreement, including wages, hours of work, and other terms and conditions. The Commission noted that the agreement had been negotiated between Kenny Projects and the employees' representative, and that it had been independently certified as a genuine agreement. The Commission also considered the absence of any objections from the parties involved, including the employees who would be covered by the agreement. Based on these factors, the Commission concluded that the agreement met the requirements for approval and was fair and reasonable. Consequently, the Commission approved the Kenny Projects Pty Ltd Construction Enterprise Agreement 2015.
