I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Kempsey Local Environmental Plan 2013 (Amendment No 9).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land in Zone RU1 Primary Production, Zone RU2 Rural Landscape, Zone RU4 Primary Production Small Lots and Zone R5 Large Lot Residential to which Kempsey Local Environmental Plan 2013 applies.

Amendment of Kempsey Local Environmental

Plan 2013

[1]      Land Use Table

Omit “Bed and breakfast accommodation;” and “Farm stay accommodation;” wherever occurring in item 3 of the matter relating to Zone RU1 Primary Production, Zone RU2 Rural Landscape and Zone RU4 Primary Production Small Lots.

Insert “Information and education facilities;”, “Restaurants or cafes;” and “Tourist and visitor accommodation;” in alphabetical order in item 3.

Omit “Any development not specified in item 2 or 3” wherever occurring in item 4.

Insert instead “Backpackers’ accommodation; Hotel or motel accommodation; Serviced apartments; Any other development not specified in item 2 or 3”.
