1      Name of Plan

This Plan is Kempsey Local Environmental Plan 1987 (Amendment

No 106).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to Lot B, DP 900729, 316 Chain O’Ponds Road,

Collombatti.

Clause 70

Insert after clause 69:

70      Development of land at 316 Chain O’Ponds Road, Collombatti

This clause applies to Lot B, DP 900729, 316 Chain

O’Ponds Road, Collombatti.

(2)

Nothing in this plan prevents the Council from granting consent to the carrying out of development on land to which this clause applies for the purposes of a cemetery or crematorium, or both a cemetery and crematorium, and any associated facilities that are appropriately scaled, and primarily intended, to support those purposes.

(3)

In this clause:

cemetery means a building or place for the interment of

deceased persons or their ashes.

crematorium means a building in which deceased persons

or pets are cremated, and includes a funeral chapel.
