360 SCHOOLS OF ARTS Kedron War Memorial, Etc., Act. 12 GEO. VI. , SCHOOLS OF ARTS. 12 Gm. VI. An Act to Transfer to and Vest in the Kedron Sub- KEDRON WAR MEMORIAL ScH.oca. OF Branch of "The Returned Sailors, Soldiers, ARTS TRANSFER ACT OF 1947. and Airmen's Imperial League of Australia, Queensland Branch," the Lands and Other Property of an Institution known as the Kedron War Memorial School of Arts." [ASSENTED TO 15TH DECEMBER, 1947.] Preamble. HEREAS about the year one thousand nine hundred and twenty-four an Institution known as the "Kedron War Memorial School of Arts" was established, the objects of such Institution being— (a) The erection and maintenance of the School of Arts building; (b) The establishment and maintenance of Libraries and Reading Rooms, the advance- ment of reading and study by the delivery of lectures and otherwise, recreation and entertainment of its members by games of skill, and generally the diffusion of know- ledge, the promotion of social intercourse and the advancement of the moral and intellectual welfare of the community: Schedule. And whereas pursuant to and for the purposes of its objects the said Institution acquired and now owns property including the freehold lands described in the Schedule to this Act, and has established and maintains upon such lands a School of Arts: And whereas the estate in fee-simple in the said lands is presently, by Nomination of Trustees Number A52422 and Deeds of Appointment of new trustees, vested in William Cunningham, Harold Daniel Skinner, Matthew Abbott, Senior, Norman Oswald O'Shaughnessy, and Charles Theophilus Adams as trustees for and on behalf of the said Institution and the members thereof for the time being upon and with and subject to the limits, powers, and conditions set out in the Schedule of Trusts to the said Nomination of Trustees:

And whereas a Special General Meeting of Members of the said Institution held on the eleventh day of September, one thousand nine hundred and thirty-eight,, resolved— (a) That the whole of the property of the Kedron War Memorial School of Arts be forthwith transferred to the Kedron Sub-Branch of the Returned Sailors, Soldiers, and Airmen's Imperial League of Australia, Queensland Branch; and (b) That there shall be no consideration for the transfer and that the Institution shall not be liable for any costs, charges, duties, fees, or expenses whatsoever in connection with or arising out of the transfer : And whereas such resolution was confirmed by a further Special General Meeting of Members of the said Institution held on the twenty-first day of October, one thousand nine hundred and forty-seven: And whereas it is desirable to effect such transfer and for that purpose to empower and authorise the trustees hereinbefore mentioned to do and execute all such acts, matters, and things as are appropriate to convey and transfer the said lands and other property in the manner directed by or under any Act— Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1 This Act may be cited as " The Kedron War Short title. Memorial School of Arts Transfer Act of 1947." 2. (1.) 362 SCHOOLS OF ARTS. Kedron War Memorial, Etc., Act. 12 GEO. VI., 1947. (2.) The trustees of the lands described in the Schedule. Schedule to this Act may, and are hereby authorised to, by a nomination of trustees duly made and executed in accordance with the provisions of *"The Real Property Acts, 1861 to 1942," transfer to the trustees of the Kedron Sub-Branch of "The Returned Sailors, Soldiers, and Airmen's Imperial League of Australia, Queensland Branch," all estate or interest in fee-simple in the said lands to be held by such lastmentioned trustees upon the trusts for which such Sub-Branch may hold lands and other property under and subject to the constitution, rules, and by-laws of the said League, but absolutely freed and discharged from the trusts upon and subject to which such lands have heretofore been held. Tstaurkbuejsetlceatenstdosto Sub- ( B3. ) raAncnhybpyrovpireturteyowf hthiicshAisctvsehsatleldbeinsothveessateidd elixaibsitliintiges. scuhbarjgeecdt toon aonryafdfeecbtti, ngliathbeilsiatym,eo. r obligation specially On and after the date of the passing of this Act neither the said Institution nor the trustees thereof shall be subject to any liability in respect of any debt, liability, or obligation hereinbefore in this section mentioned, but every such liability shall, on and after such date, be imposed on and discharged by the said Sub-Branch. Moreover all such costs, charges, duties, fees, and expenses as are duly payable in respect of the transfer in accordance with this Act of the lands and other property of the said Institution shall be paid by the said Sub- Branch which shall indemnify and keep indemnified the said Institution and the trustees thereof against any liability to any such payment. SCHEDULE. All that piece or parcel of land situated in the county of Stanley, parish of Kedron, described as subdivision 233 of portion 109, con- taining an area of 27 perches (be the same a little more or less), being the whole of the land contained in Certificate of Title No. 234372, volume 1347, folio 112. All that piece or parcel of land situated in the county of Stanley, parish of Kedron, described as subdivisions 231 and 232 of portion 109, containing an area of 39.9 perches (be the same a little more or less), being the whole of the land contained in Certificate of Title No. 173024, volume 1047, folio 14. * 25 V.
