GAUDRON J:   This matter was heard in Brisbane by the Chief Justice and Justices Toohey, Gummow, Kirby and myself on 25 June 1997.  The order of the Court was handed down at the conclusion of that hearing.  The Court is now in a position to publish its reasons.
