HIS HONOUR:   On 19 August 2003 Justice Hayne, acting pursuant to Order 58 rule 4(3), directed the Registrar not to issue a notice of motion presented by the applicant, Mr William Kavanagh, without the leave of a Justice first being obtained.  In accordance with that direction and following a propounded proceeding, the matter has been referred to me to consider whether such leave should be granted.  In my opinion it should not.  The application is dismissed.  I publish my reasons.

The Court will now adjourn until 10.15 this morning.
