REPEAL

AN ACT to repeal the Katanning Electric Lighting

and Power (Private) Act, 1904.

[Assented to 10th November, 1959.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title.

1.

This Act may be cited as the Katanning Electric

Lighting and Power Repeal Act, 1959.

Commence-

ment.

2.

(1) This Act shall come into operation on a

day to be fixed by proclamation.

(2) The Governor shall not make a proclamation

under this section unless the person who is the

"undertaker" for the time being, within the meaning

of that expression in section two of the Katanning Electric Lighting and Power (Private) Act, 1904, notifies the Governor in writing that it has received the purchase price of its electricity supply under- taking at Katanning which it operates under the provisions of that Act from, and has given possession of the undertaking to, The State Electricity Commission of Western Australia pursuant to clause four of a certain agreement in writing dated the fourteenth day of December, one thousand nine hundred and forty-eight, made between the Commission of the one part and Katanning Flour Mills Limited of the other part and has agreed in writing with The State Electricity Commission of Western Australia, to consent to the repeal of that Act.

3. The Katanning Electric Lighting and Power Repeal.

(Private) Act, 1904, is repealed.
