K R I v The Queen

The appellant, K R I, was convicted by a jury in the Supreme Court of Victoria of multiple counts of sexual penetration of children under 16 years, and multiple counts of indecent acts with or in the presence of children under 16 years. The appellant applied for leave to appeal against his conviction, raising several grounds of appeal. The primary issue for the court was whether the failure to order separate trials for the appellant's multiple convictions, the alleged collusion between the complainants, the judge's direction to the jury regarding collusion, the failure to summarise evidence and submissions of counsel, and the judge's comments on the children's possible reaction to sexual abuse, resulted in a miscarriage of justice.

The court found that the failure to order separate trials did not cause a miscarriage of justice, as the evidence was properly before the jury and the appellant was not prejudiced by the joinder of charges. The court also found that the alleged collusion between the complainants did not deprive the tendency and coincidence evidence of significant probative value, as the evidence was properly admitted and the jury was adequately directed on the possibility of collusion. The court further found that the failure by the judge to summarise evidence and submissions of counsel did not cause a miscarriage of justice, as the jury was properly directed on the law and the evidence. Lastly, the court found that the judge's comments on the children's possible reaction to sexual abuse did not cause a miscarriage of justice, as the comments were not such as to deprive the appellant of a fair trial.

The application for leave to appeal was dismissed.
