Act No. 161, 1987

An Act to amend the Justices Act 1902 with respect to the service of

summonses by officers under the Prevention of Cruelty to Animals Act 1979.

Justices (Prevention of Cruelty to Animals) Amendment 1987

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the "Justices (Prevention of Cruelty to

Animals) Amendment Act 1987".

Amendment of Act No. 27, 1902, sec. 63 (Manner of service of summons)

2. The Justices Act 1902 is amended by omitting section 63 (2A) and

by inserting instead the following subsection:

(2A) In subsection (2), "public officer" means a person acting in an

official capacity—

(a)

as an officer or a temporary employee under the Public Service Act 1979;

(b)

as an officer or employee of a corporation that, for the purposes of any Act, is a statutory body representing the Crown;

(c)

as an officer or employee of a council within the meaning of the Local Government Act 1919;

(d)

as an officer or employee of a pastures protection board under the Pastures Protection Act 1934; or

(e)

as an officer within the meaning of the Prevention of Cruelty to Animals Act 1979.
