This regulation may be cited as the Justices of the Peace and Commissioners for Declarations Amendment Regulation (No. 1) 1995 . ˙ Regulation amended 2. This regulation amends the Justices of the Peace and Commissionersfor Declarations Regulation 1991 . ˙ Amendment of s 8 (Qualification of justice of the peace (Magistrates Court)) 3.(1) Section 8(1)— omit, insert— ‘ 8.(1) A person is qualified for appointment as a justice of the peace (magistrates court) only if, immediately before appointment, the person— (a) holds office as a justice of the peace (qualified) under the Act, section 15(1); or (b) is a retired Magistrate who applies for appointment within 5 years after the person’s retirement as a Magistrate.’.
