Justices Amendment Rules (No. 2) 2001

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following rules under the Justices Act 1959 .14 May 2001

1Short titleThese rules may be cited as the Justices Amendment Rules (No. 2) 2001 . 2CommencementThese rules take effect on the day on which their making is notified in the Gazette. 3Principal RulesIn these rules, the Justices Rules 1976 are referred to as the Principal Rules. 4Rule 58D amended (Applications)Rule 58D(2) of the Principal Rules is amended by omitting paragraphs (a) and (b) and substituting the following paragraph: (a) under section 106B(1) , 106B(3) , 106G(2) or 106GD(1)(d) is to be in a form approved by the Chief Magistrate; and 5Rule 58DA insertedAfter rule 58D of the Principal Rules, the following rule is inserted: 58DAElectronic filing of applications (1)  An authorised source may file an application by electronic means. (2)  An application filed by electronic means is to state in a manner approved by the Chief Clerk of Petty Sessions that subrule (3) has been complied with. (3)  An authorised source is to retain in a safe place the original signed application that complies with rule 58D(5). (4)  In this rule, authorised source means a person or agency approved by the Chief Clerk of Petty Sessions to file applications under Part XA of the Act by electronic means with a clerk. 6Schedule I amendedPart V of Schedule I to the Principal Rules is amended by omitting Forms 48A, 48B and 48C.
