s1 3 s4 Justices Amendment (No. 5) No. 378, 1996 ˙ Short title 1. This regulation may be cited as the Justices Amendment Regulation (No. 5) 1996 . ˙ Commencement 2. Sections 5 to 10 commence on 19 December 1996. ˙ Regulation amended 3. This regulation amends the Justices Regulation 1993 . ˙ Insertion of new pt 1A 4. After part 1— insert — ‘ PART 1A—COMPUTER WARRANTS ˙ ‘ Prescribed warrants—Act, s 66(4) ‘ 2A. For section 66(4) of the Act, 1 the following types of warrant are prescribed— (a) a warrant issued under the Bail Act 1980 ; (b) a warrant of commitment and warrant of execution issued under the Justices Act 1886 ; (c) a warrant of commitment issued under the PenaltiesandSentences Act 1992 . ˙ ‘ Approved procedures for computer warrants—Act, s 67(1)(b) ‘ 2B. For section 67(1)(b) of the Act, 2 the following procedures for computer stored information are approved— 1 Section 66(4) (Purpose and application of division) 2 Section 67(1)(b) (Approved procedures for computer warrants)

s4 4 s4 Justices Amendment (No. 5) No. 378, 1996 (a) procedures made by the chief executive and stated in the departmental document titled ‘Computer Warrant Procedures’; 3 (b) procedures made by the commissioner of the police service and stated in the Department of Police document titled ‘Operational Procedures Manual’, section 13.20. 4 ˙ ‘ Prescribed information—Act, s 69B(2) ‘ 2C. A document made under the approved procedures and used to execute a computer warrant must include— (a) the following information about the warrant— (i) type; (ii) reference number; (iii) date of issue; (iv) issuing entity’s name and location; (v) Act under which it was issued; (vi) for a warrant of commitment for failure to pay an amount— (A) amount payable; and (B) default period of imprisonment; (vii) for a warrant of execution—the amount payable; and (b) the following information about the person to whom the warrant relates— (i) name; (ii) address stated on the warrant; (iii) latest known address; and 3 A copy of the document may be inspected, free of charge and during normal working hours, at any Magistrates Court and the department’s head office. The department’s head office is at State Law Building, George and Ann Streets, Brisbane. 4 A copy of the document may be inspected, free of charge, at any police station, or bought from the Department of Police, Police Headquarters, 100 Roma Street, Brisbane.

s5 5 s5 Justices Amendment (No. 5) No. 378, 1996 (c) the following information about the offence or alleged offence in relation to which the warrant was issued— (i) description of the offence or alleged offence; (ii) provision of the Act or statutory instrument that was contravened or allegedly contravened; (iii) date of the offence or alleged offence; (iv) place where the offence or alleged offence happened. ˙ ‘ Certification of a document made under the approved procedures and used to execute a computer warrant or written warrant—Act, ss 69B(5)(b) and 69E(4)(b) ‘ 2D.(1) For section 69B(5)(b) of the Act, 5 if anyone is arrested on execution of a computer warrant using a document made under the approved procedures, the document is to be certified by the arresting officer. ‘ (2) For section 69E(4)(b) of the Act, 6 if anyone is arrested on execution of a written warrant using a prescribed document, 7 the prescribed document is to be certified by the arresting officer. ˙ ‘ Prescribed document—Act, s 69E(1)(b) ‘ 2E. The document titled ‘Warrant work list’, made under the approved procedures and used to execute a written warrant is prescribed for section 69E(1)(b) of the Act. 8 ’. ˙ Replacement of sch 1, pts 1 and 2 5.
