This regulation may be cited as the Justices Amendment Regulation (No. 2) 1997 . ˙ Commencement 2.(1) Section 8 commences on 1 January 1998. 1 (2) Section 9 commences on the day the Health Legislation AmendmentAct (No. 2) 1996 , section 8 (to the extent it inserts new Health Services Act1991 , part 3) commences. 2 ˙ Regulation amended 3. This regulation amends the Justices Regulation 1993 . ˙ Amendment of s 4 (Administering authority (nominated laws)) 4. Section 4(2)— omit, insert— ‘ (2) However, the administering authority for an infringement notice and an infringement notice offence is— (a) for a nominated law in schedule 2, column 1—the person specified in schedule 2, column 2 for the law; or (b) for the Environmental Protection Act 1994 3 — (i) if the infringement notice is served by an employee of a local government—the local government’s chief executive officer; or 1 Section 8 (Amendment of sch 1, pt 14B (Environmental Protection (Water) Policy 1997)) 2 Section 9 (Insertion of new sch 1, pt 18A) 3 The Act includes statutory instruments made under it. Section 6— omit, insert— ˙ ‘ Authorised person for nominated laws for reminder notice, enforcement notice and withdrawal from acting under the Act, pt 4A, div 3 ‘ 6.(1) In this section— “authorised person” means the person authorised to— (a) serve a reminder notice; and (b) give an enforcement notice; and (c) withdraw from acting under part 4A, division 3 4 of the Act. ‘ (2) The authorised person for an infringement notice offence is— (a) for the EnvironmentalProtectionAct1994 —an authorised person appointed under section 128 5 of that Act; or (b) for the Motor Accident Insurance Act 1994 —the chief executive of the department in which the TransportInfrastructure(Roads)Act 1991 is administered; or (c) for a nominated law mentioned in schedule 2, column 1 (other than the MotorAccidentInsuranceAct1994 )—the person mentioned in schedule 2, column 2 for the law; or (d) for any other nominated law—the chief executive of the department in which the law is administered.’. 4 Part 4A, division 3 (Enforcement of infringement notices by registration) 5 Section 128 (Appointment of authorised persons)
