s1 8 s5 Justices Amendment (No. 1) No. 48, 1996 ˙ Short title 1. This regulation may be cited as the Justices Amendment Regulation (No. 1) 1996 . ˙ Commencement 2. Sections 4, 5(1) and (3) and 12 commence on 26 March 1996. ˙ Regulation amended 3. This regulation amends the Justices Regulation 1993 . ˙ Amendment of s 2 (Definitions) 4. Section 2— insert— ‘ “local law” means any provision of a local law (other than a local law in relation to regulated parking or an offence against the person) contravention of which may result in a maximum penalty of not more than 50 penalty units or, if the penalty is expressed as a dollar amount, $3 750 for an offence against the provision. “regulated parking” has the meaning given by the Traffic Act 1949 .’. ˙ Amendment of pt 2 (Infringement Notices) 5.(1) Part 2, before section 3, as heading— insert— ‘ Division 1—Nominated laws ’. (2) Section 6, ‘enforcement order’— omit, insert— ‘enforcement notice’. (3) Before section 7— insert—

For part 4A of the Act— (a) an offence against a local law is an offence (an “infringement notice offence” ) to which the part applies; and (b) the amount worked out under schedule 1A is the penalty (the “infringement notice penalty” ) payable for the offence under an infringement notice. ˙ ‘ Administering authority (local laws) ‘ 6B. The administering authority for an infringement notice and an infringement notice offence for a local law is the chief executive officer of the local government that made the local law. ˙ ‘ Authorised person for infringement notice (local laws) ‘ 6C. The person authorised to serve an infringement notice under section 98C of the Act1 for an infringement notice offence for a local law is an authorised person under the Local Government Act 1993 , section 676. 2 ˙ ‘ Authorised person for local laws for reminder notice, enforcement notice and withdrawal from acting under pt 4A, div 3 of the Act ‘ 6D. The person authorised to— (a) serve a reminder notice; and (b) give an enforcement notice; and (c) withdraw from acting under part 4A, division 3 of the Act; 3 1 Section 98C of the Act deals with the service of infringement notices generally. 2 The Local Government Act 1993 , section 676 is about the appointment of authorised persons. 3 Part 4A, division 3 deals with the enforcement of infringement notices by registration.

Section 11— omit, insert— ˙ ‘ Identifying particulars for animals ‘ 11. The identifying particulars under section 98C(3)(f) of the Act are a sufficient number of the following to reasonably identify the animal— (a) species; (b) breed; (c) colour; (d) sex; (e) age; (f) identification or registration tags; (g) collars; (h) brands or tattoo; (i) electronically coded implant; (j) marks or scars; (k) other noticeable distinguishing marks or features.’. ˙ Replacement of pt 3 heading 7. Part 3 heading— omit, insert — ‘ PART 3—MAGISTRATES COURTS PROVISIONS ’.

After section 14— insert— ˙ ‘ Appointment and naming of certain districts and divisions for Magistrates Courts ‘ 14A.(1) A district is appointed and named the Brisbane district for Magistrates Courts. ‘ (2) The following divisions are appointed and named as divisions of the Brisbane district for Magistrates Courts— • Central • Cleveland • Holland Park • Inala • Logan • Redcliffe • Sandgate • Wynnum. ‘ (3) The boundaries of the Brisbane district are set out in schedule 5, part 1. ‘ (4) The boundaries of the Central, Cleveland, Holland Park, Inala, Logan, Redcliffe, Sandgate and Wynnum divisions are set out in schedule 5, part 2, divisions 1 to 8.’. ˙ Insertion of pt heading 9. Before section 15— insert— ‘ PART 4—GENERAL ’.

The following statutory rules, made under the Decentralisation of Magistrates Court Act 1965 and given continued effect under the JusticesAct 1886 , section 22B(4), are repealed— • the statutory rule published in the gazette as an order in council on 27 January 1968 at pages 405 and 406 • the statutory rule published in the gazette as an order in council on 10 February 1973 at pages 581 and 582.’. ˙ Replacement of sch 1 (Nominated laws for infringement notice offences) 11. s 12 68 s 12 Justices Amendment (No. 1) No. 48, 1996 ‘ SCHEDULE 1A ‘ INFRINGEMENT NOTICE PENALTIES FOR LOCAL LAWS section 6A ˙ ‘ How to work out infringement notice penalty ‘ 1.(1) The infringement notice penalty for an offence against a local law is— (a) if the local law is a 31D law—$50.00; or (b) if paragraph (a) does not apply and the penalty provided under the local law for its contravention is expressed in penalty units—the penalty specified in the following table, column 3 opposite the range of penalty units in column 1 into which the penalty provided under the local law falls; or (c) if paragraph (a) does not apply and the penalty provided under the local law for its contravention is expressed as a dollar amount—the penalty specified in the following table, column 3 opposite the range of dollar amounts in column 2 into which the penalty provided under the local law falls. ‘ (2) In subsection (1)(a)— “31D law” means a local law— (a) to which, immediately before the commencement of subsection (1)(a), the Local Government Act 1936 , section 31D applied; and (b) the penalty for contravention of which is not less than $50.00.
