AN ACT to amend section thirty of the Justices Act,

1902-1936.

[Assented to 26th November, 1942.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title.

1.

This Act may be cited as the Justices Act Amend- ment Act, 1942, and shall be read as one with the Justices Act, 1902-1936, as reprinted in the Sessional Volume of Statutes for the year 1936 (hereinafter called the prin- cipal Act).

Section thirty of the principal Act is amended by

deleting the first proviso and inserting in lieu thereof a

proviso as follows:—

Provided that when two or more justices are pre- sent and acting at the hearing of any matter and do not agree, if one of such justices is a police or resident magistrate, the decision of the police or resident magistrate shall prevail, notwithstanding that a majority of the justices are of a different opinion.
