JUSTICES ACT 1902—REGULATION

(Relating to the short description of the offence of using a council's water supply

contrary to a council notice)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Justices Act 1902, has been pleased to make the

Regulation set forth hereunder.

The Justices (Short Descriptions of Local Government Offences) Regulation 1993 is amended by inserting in Schedule 1 after the matter relating to section 633 (2) the following matter:

Section 637 (1)—wilfully or wilful/negligent use of water
negligently misusing water contrary to council notice

from a public water supply (where the offence involves using a council’s water supply contrary to a council notice restricting water use)

EXPLANATORY NOTE

The object of this Regulation is to prescribe a short description, for the purposes of section 145B of the Justices Act 1902, of the offence of using a council’s water supply in contravention of a notice of the council restricting water use. The offence is created by section 637 (1) of the Local Government Act 1993, read in conjunction with clause 26 of the Local Government (Water, Sewerage and Drainage) Regulation 1993.

This Regulation is made under the Justices Act 1902, including section 154 (the general regulation-making power) and section 145B.
