JUSTICES ACT 1902—REGULATION
(Relating to short descriptions of road train offences under the
Motor Traffic Regulations 1935)

Commencement
1. This Regulation commences on 1 November 1994.
Amendment relating to road train offences
2. The Justices (Short Descriptions of Motor Traffic and Other Offences) Regulation 1986 is amended by omitting from Schedule 1 the matter relating to Regulations 113B (1) (a), 129 of the Motor Traffic Regulations 1935 and by inserting instead the following matter:

3. The Justices (Short Descriptions of Motor Traffic and Other Offences) Regulation 1986 is amended by omitting from Schedule 1 the matter relating to the Motor Vehicle Driving Instructors Act 1961 and the matter relating to the Motor Vehicle Driving Instructors Regulations
1962.
EXPLANATORY NOTE
The object of this Regulation is to prescribe separate short descriptions under section 145B (2) of the Justices Act 1902 for certain road train offences under the Motor Traffic Regulations 1935.
It is proposed (separately) to amend the Motor Traffic Regulations 1935 (with effect from 1 November 1994) so that a $750 penalty applies to a violation of route limitations placed on a permit to drive road trains that exceed 23 metres in length, but the existing penalty of $99 continues to apply to other conditions placed on permits to drive road trains (of any length).
The proposed subdivision of the short descriptions under the Justices Act 1902
reflects the division of penalties to be introduced in the Motor Traffic Regulations 1935.
This Regulation also contains an amendment for the purposes of law revision,
omitting the short descriptions for offences under the now repealed Motor Vehicle
Driving Instructors Act 1961 and Motor Vehicle Driving Instructors Regulations 1962.
This Regulation is made under sections 145B (Short description of certain offences)
and 154 (including the general regulation-making power) of the Justices Act 1902.
