JUSTICES ACT 1902—REGULATION
(Relating to short descriptions of offences under the Local Government Act 1993)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Justices Act 1902, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 July 1994.
Amendments
2. Schedule 1 to the Justices (Short Descriptions of Local Government
Offences) Regulation 1993 is amended:
(a) by inserting in appropriate order the following matter:
Section 628 (2)—fail to fail to comply with order to
comply with an order given remove object/matter from in terms of order No. 27 in public place/prevent deposit the Table to section 124 (To of object/matter in public remove an object or matter place from a public place or prevent any object or matter being deposited there)
(b)
by omitting from Column 1 in the matter relating to section 629 (2) the words “public land” and by inserting instead the words “a public place”;

| (c) | by omitting from Column 1 in the matter relating to section 632 (1) the words “on public land or in a public bathing place under the control of a council” and by inserting instead the words “in a public place within the area of a council”; |
| (d) | by omitting from Column 2 in the matter relating to section 632 (1) the words “on public land/in bathing place” and by inserting instead the words “in public place”. |
EXPLANATORY NOTE
The objects of this Regulation are:
| (a) | to prescribe the short description that, by virtue of section 145B of the Justices Act 1902, is sufficient to state or describe the offence under section 628 (2) of the Local Government Act 1993 in any information, complaint, summons, warrant, notice, order or other document; and |
| (b) | to make minor changes to the short descriptions of certain offences under the Local Government Act 1993 consequential on the amendment of those offences by the Local Government Legislation (Miscellaneous Amendments) Act 1994. |
This Regulation is made under the Justices Act 1902, in particular section 145B.
