JUSTICES ACT 1902 - REGULATION

(Relating to fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Justices Act 1902, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 January 1991.

Amendment

2. The Justices Act (General) Regulations are amended by

omitting the Schedule and by inserting instead the following Schedule:

SCHEDULE - FEES

(Reg. 2)

Fees payable in connection with proceedings before any Justice or

Justices under the Justices Act 1902 and the Regulations thereunder.

1. (1) Information or complaint in writing, summons and copy
of service, one defendant .................................................... 45.00

(2) As in paragraph (1), but for each additional defendant 30.00

2.      (1) Information or complaint in writing, with warrant to

apprehend, one defendant ........................................................ 45.00 (2) As in paragraph (1), but for each additional defendant 30.00

3.      (1) Any application not otherwise provided for or order for hearing, notice of hearing and necessary copies of service by Police (if required) ............................................. 45.00

(2) As in paragraph (1), but for each additional respondent 30.00

4.      Deposition that a person is a material witness (copy and service) or warrant for witness ................................................... 45.00

5. (1) Subpoena, including copy if desired, each witness ....... 25.00

9.      Except where otherwise provided under or in pursuance of any other Act, for each copy of depositions, transcripts/diskette:

(b)	per page (or equivalent) where the matter being
transcribed is over 3 months old ........................................ 7.50

EXPLANATORY NOTE

The object of this Regulation is to amend the Justices Act (General) Regulations so as to increase the fees to be demanded and taken in respect of proceedings under the Justices Act 1902.
