JUSTICES ACT 1902 - REGULATION
(Relating to enforcement of fines)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Justices Act 1902, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 9 February 1990.
Amendment
2. The Justices (Warrants of Commitment) Regulation 1986 is
amended:
| (a) | by omitting clause 1 and by inserting instead the following clause: |
Citation
1. This Regulation may be cited as the Justices (Warrants of
Commitment and Fine Enforcement) Regulation 1986.
| (b) | by omitting clause 3 and by inserting instead the following clauses: |
Issue of warrant in relation to certain traffic offences
3. The manner in which an authorised justice is to be notified
that a warrant under section 87 of the Justices Act 1902 may be

issued (in relation to an offence referred to in subsection (4) (a) of that section) is by means of a notice issued by the Roads and Traffic Authority.
Recovery of amounts payable to “private payees”
4. For the purposes of section 89D of the Justices Act 1902, the manner in which a person or body is to be notified that payment of an amount payable (in respect of an offence referred to in section 87 (4) (a) of the Justices Act 1902) may be enforced as though it were an amount payable by virtue of a judgment for the payment of that amount under the Local Courts (Civil Claims) Act 1970 is by means of a notice issued by the Roads and Traffic Authority and served on the person or body.
EXPLANATORY NOTE
The object of this Regulation is to amend the Justices (Warrants of Commitment) Regulation 1986, as a result of the commencement of amendments to the Justices Act 1902 contained in the Fine Enforcement Legislation (Amendment) Act 1989, to prescribe the manner in which notification is to be given that a warrant of commitment may be issued, or that civil debt recovery action may be taken, in relation to certain traffic offences.
