JUSTICES ACT 1902—REGULATION

(Relating to short descriptions of offences concerning heavy vehicles)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Justices Act 1902, has been pleased to make the

Regulation set forth hereunder.

So much of Sched ule 1 t o the Justices (Short Descriptions of Motor Traffic and Other Offences) Regulation 1986 as appears under the heading “Motor Traffic Regulations 1935” is amended:

(a)

by omitting from the first item that relates to Regulation 80 ( 1) the word “horn” wherever occurring;

(b)

by inserting in the two items that relate to paragraph 76 of Schedule F after the matter “Schedule F” wherever occurring the matter “, clause 7.4 (1) of the Appendix to Division 7 of Schedule F”;

(c)

by inserting in the item that relates to paragraph 47A of Schedule F after the matter “Schedule F” the matter “, clause 9.2 (2) and (3) of the Appendix to Division 7 of Schedule F”;

(d)

by inserting in the two items that are expressed to relate to paragraph 82 (a) of Schedule F after the matter “Schedule F” wherever occurring the matter “, clause 2.19 (2) of the Appendix to Division 7 of Schedule F”;

(e)

by omitting from the two items that are expressed to relate to paragraph 82 of Schedule F the matter “Regulation 92 (1) (b), (2), paragraph 82 of Schedule F” wherever occurring and by inserting instead the matter “Regulations 92 (1) (b), 129, paragraph 82 (a) of Schedule F, clause 2.19 (2) of the Appendix to Division 7 of

Schedule F” ;

by omitting all the matter relating to paragraph 42A of Schedule F and by inserting instead the following matter:

EXPLANATORY NOTE

The object of this Regulation is to modify and update certain short descriptions of offences relating to heavy vehicles under the Motor Traffic Regulations 1935 as a consequence of amendments made to those offences on 6 October 1995.

This Regulation is made under the Justices Act 1902, including sections 145B (Short

description of certain offences) and 154 (the general regulation-making power).
