His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Justices Act 1902.

Explanatory note

The object of this Regulation is to amend the Occupational Health and Safety Legislation (Short Description of Offences) Regulation 1996 so as to facilitate the issue of penalty notices and legal process for an offence under section 18 of the Occupational Health and Safety Act 1983 as inserted by the Occupational Health and Safety Amendment Act 1997.

This Regulation is made under section 145B of the Justices Act 1902.

Amendment Regulation 1997

1 Name of Regulation

This Regulation is the Occupational Health and Safety Legislation (Short Descriptions of Offences) Further Amendment Regulation 1997.

2 Commencement

This Regulation commences on 1 November 1997.

3   Amendment of occupational Health and Safety Legislation (Short Descriptions of Offences) Regulation 1996

The Occupational Health and Safety Legislation (Short Descriptions of Offences) Regulation 1996 is amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

Schedule 1 Amendment

(Clause 3)

Schedule 1 Short descriptions of offences

Omit the matter relating to section 18 of the Occupational Health
and Safety Act 1983.

Insert instead:

Section 18 (1) (a) designer/rnanufacturer/supplier not ensure
plant/substance safe/not health risk
Section 18 (1) (b) designer/manufacturer/supplier not provide/
arrange information on use of plant/substance
