Revision) Regulation 1996

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Justices Act 1902.

Explanatory note

The objects of this Regulation are:

(a)

to update a reference in the Justices (Short Description of Fisheries Offences) Regulation 1995 to an offence relating to the sale of eastern rock lobster, as a consequence of a re-arrangement of the offence provisions in the Fisheries Management (General) Regulation 1995, and

(b)

to repeal the Fisheries (Short Description of Offences) Regulation 1985, as the provisions of that Regulation are obsolete.

This Regulation is made under section 145B of the Justices Act 1902.

Regulation 1996

1 Name of Regulation

This Regulation is the Justices (Short Descriptions of Fisheries

Offences) Amendment (Law Revision) Regulation 1996.

2 Commencement

This Regulation commences on 1 July 1996.

  1. Amendment of Justices (Short Descriptions of Fisheries Offences) Regulation 1995

    The Justices (Short Descriptions of Fisheries Offences)

    Regulation 1995 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Insert after clause 3:

4 Repeal

(1) The Fisheries (Short Description of Offences)
Regulation 1985 is repealed.
(2) The repeal of a prescribed expression in the repealed Regulation does not affect the validity of any information, complaint, summons, warrant, notice, order or other document in which the expression is used and any such document continues to have effect as if that expression had not been repealed.
(3) Subclause (2) applies to any information, complaint, summons, warrant, notice, order or other document (whether issued, given or made before or after the repeal) that relates to an offence alleged to have been committed before the repeal.

Insert in columns 1 and 2, respectively, of Schedule 1 in the matter relating to the Fisheries Management (General) Regulation 1995 the following matter:

Clause 119F—sell a whole eastern sell whole lobster without tag
rock lobster that does not have a
