An Act to amend the Justice and Related Legislation (Further Miscellaneous Amendments) Act 2009

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Justice and Related Legislation (Further Miscellaneous Amendments) Amendment Act 2010 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Justice and Related Legislation (Further Miscellaneous Amendments) Act 2009 is referred to as the Principal Act. 4Section 30A insertedAfter section 30 of the Principal Act, the following section is inserted: 30ASection 4 amended (Interpretation) Section 4 of the Principal Act is amended by omitting the definition of "authorised person" and substituting the following definition: authorised person means – (a) the Director of Public Prosecutions or an Australian legal practitioner acting on behalf of the Director of Public Prosecutions; or (b) a police officer; or (c) an Australian legal practitioner employed in the responsible Department in relation to the Police Offences Act 1935 ; or (d) a probation officer; 5Section 31 amended (Section 24 substituted)Section 31 of the Principal Act is amended as follows: (a) by omitting subsection (1) of section 24 as substituted and substituting the following subsection: (1)  If a court makes an order suspending the whole or a part of a sentence of imprisonment, the order is subject to the condition that the offender does not commit another offence punishable by imprisonment during the period the order is in force. (b) by omitting paragraph (a) of section 24(4) as substituted and substituting the following paragraph: (a) section 28(b), (c), (d), (e), (f) and (g); (c) by omitting paragraph (a) of section 24(5) as substituted and substituting the following paragraph: (a) section 37(1)(b), (c), (d), (e), (f) and (g); 6Repeal of ActThis Act is repealed on the ninetieth day from the day on which it commences.
