[ASSENTED TO 11TH APRIL, 1946.] W Preamble. HEREAS by *"The Jury (War Emergency) Act of 1942" it was amongst other things enacted that the said Act should, unless sooner repealed, continue in force until six months after His Majesty ceased to be engaged in war and no longer; AND WHEREAS doubts having arisen as to whether the said Act is still in force or whether the said Act ceased to be in force on the second day of March, One thousand nine hundred and forty-six, oron some other day, it is considered desirable to enact the following provisions ;- Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows ;- Short title. 1. This Act may be cited as "The J1J,ry ( War Emergency) Act of 1942 Extension and Repeal Act of 1946." Extension of" The Jury (War Emergency) Act of 1942." 2. It is hereby declared that *" The Jury (War Emergency) Act of 1942" is now, and has at all times since the passing thereof been, in force and that the same shall continue to be in force until repealed as hereinafter provided, and the operation of the said Act is hereby extended so far as may be necessary to give effect to the foregoing provisions. poVrfoaclcieedreatdatiiinongns. prece 3 d . inNg ostwecitthiostna-nding the provisions of the last (i.) Any trial which has been commenced or holden prior to the passing of this Act but subsequent to the first day of March, One thousand nine hundred and forty-six, with a jury consisting of twelve persons; and (ii.) Any trial which shall be commenced or holden on or after· the passing of this Act and before the repeal of *" The Jury (War Emergency) Act of 1942" with a jury consisting of twelve persons, shall be valid and lawful to the same extent as if *" The Jury (War Emergency) Act of 1942" (except sections * 6 G. 6 No. 37, 1942-43Sess. v., p. 316.
1945. WAR LEGISLATION. Jury (War Emergency), Etc., Repeal Act. 463 four and five thereof) had ceased to be in force on the second day of March, One thousand nine hundred and forty-six. 4. *" The Jury (War Emergency) Act oJ 1942" is~ ~ a~ ~ ~ and shall be hereby repealed on and from a day to be(war i?roclairned by the Governor in Council by Proclamation ~ rn, errncy) published in the Gazette. . 1:1:." 5. Notwithstanding the repeal of *" The Jury (War Saving. Emergency) Act oJ 1942 "- (i.) Where a trial with a jury consisting of less than twelve persons has actually commenced before the day of the repeal of the said Act and is in progress on that day such trial shall be had and continued under the said Act; (ii.) Where any person over the age of sixty years has been· summoned to serve upon a jury at any sittings such person shall be qualified and liable to so serve until the conclusion of the said sittings, and the operation of the said Act is hereby extended so far as may be necessary to give effect to the foregoing provisions. * 6 G. 6 No. 37, 1942-43 Sess. v., p. 316.
