An Act to amend an Act passed in the Four th
Year of Her Majesty's Reign inti tuled " An

" Act to provide for the Trial by Jury in Civil " and Criminal Cases in the Circuit and other " Courts to be holden within the Colony of New " South Wales and its Dependencies." [23rd.

W H E R E A S by an A c t passed in t he four th year of the re ign of

H e r present Majesty Queen Victor ia in t i tu led " An Act to

" provide for the Trial by Jury in Civil and Criminal Cases in the " Circuit and other Courts to be holden within the Colony of New " South Wales and its Dependencies" i t is among other th ings enacted t h a t all cr imes and all civil issues of fact which shal l be t r ied or pro­ secuted wi th in ci ther t h e Dependencies of P o r t Phi l l ip or New Zealand respectively whether in t h e Supreme Cour t or in any Cour t of Q u a r t e r Sessions shall be t r ied by a j u r y of twelve inhab i t an t s of t h e said Dependencies respectively who shall be subject to such and t h e l ike rules regula t ions and provisions as to the i r qualifications exempt ions a n d disqualifications as in t he said Act a re made and pro­ vided wi th respect to ju r ies for t h e t r ia l of such issues respectively in t h e Circui t Cour ts of t he Colony and whereas since t h e pass ing of the said Ac t New Zealand has been formed in to a separate and indepen­ den t Colony and i t is therefore expedient to repeal so m u c h of the said A c t as re la tes to N e w Zealand Be i t therefore enacted by H i s Excel lency t h e Governor of N e w South Wales w i th t he advice of t he Legislat ive Council thereof Tha t from a n d after t he passing of th i s Ac t so m u c h of the said reci ted Act as relates to a provision for t r ia l by j u r y in t he Court of the Res ident J u d g e a t N e w Zealand and all and s ingular t he provisions of t h e said recited Ac t which relate to the duties of Jus t i ces Sheriff or Depu ty Sheriff and other officers in respect to ju r ies or which otherwise re la te to the admin is t ra t ion of jus t ice in New Zealand shall be and t h e same are hereby repealed.
