Jury Act and Oaths Act Amendment Act 1988, No. 26 213 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short Title . This Act may be cited as the Jury Act and Oaths Act Amendment Act 1988. 2. Arrangement . This Act is arranged as follows:- PART I-PRELIMINARY (SS. 1-2); PART 11-AMENDMENT OF JURY ACT (Ss. 3-4); PART III-AMENDMENT OF OATHS ACT ( ss. 5-6). PART II-AMENDMENT OF JURY ACT 3. Citation . (1) In this Part the Jury Act 1929-1982 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Jury Act 1929-1988. 4. New s. 44A. The Principal Act is amended by inserting after section 44 the following section:- "44A. Police to assist bailiffs in charge of juries . A member of the Police Force sworn to assist the officer of a court in charge of a jury in a criminal trial shall carry out in respect of the jury such duties as he is directed by the court or by the officer of the court to perform.". PART 111-AMENDMENT OF OATHS ACT 5. Citation . (1) In this Part the Oaths Act 1867-1981 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Oaths Act 1867-1988. 6. Repeal of and new s. 31 and heading and new s . 31A. The Principal Act is amended by omitting section 31 and the heading immediately preceding and substituting the following heading and sections:- "OATHS OF PERSONS RESPONSIBLE FOR JURY 31. Oath of bailiff in charge of jury. Bailiffs may be sworn to take charge of juries in the following form or to the like effect- "You swear that you will keep this jury in some safe and private place and provide them with such accommodation, meals and refreshment as the court may allow and allow no one to communicate with them and not communicate with
214 Jury Act and Oaths Act Amendment Act 1988, No. 26 them yourself without leave of the court except to ask if they have agreed upon their verdict So help you God." 31A. Oath of police officer assisting bailiff in charge of jury. (1) Members of the Police Force of the State may be sworn to assist bailiffs in charge of juries in the following form or to the like effect- "You swear that you will assist the bailiff in charge of this jury in keeping them in some safe and private place and allow no one but the bailiff to communicate with them and not communicate with them yourself without leave of the court So help you God." (2) A member of the Police Force of the State who is about to assume the duty another member has sworn (in accordance with subsection (1)) to carry out in respect of a jury may be sworn to carry out that duty by the bailiff in charge of the jury in the form prescribed by that subsection or to the like effect.".
