693 (l1EExtsrtxtl[r ANNO VICESIMO SEPTIMO ELIZABETHAE SECUNDAE REGINAE No. 78 of 1978 An Act to amend the Jury Act 1929- 1976 in certain particulars [ASSENTED TO 15TH DECEMBER, 1978] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Jury Act Amendment Act 1978. (2) The Jury Act 1929-1976 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Jury Act1929-1978.
694 Jury Act Amendment Act 1978, No. 78 2. Amendment of s. 8. Section 8 of the Principal Act is amended by, in subsection (1)- (a) in paragraph (v), omitting the words ", all being in actual practice "; (b) in paragraph (viii), omitting the words " and schoolmasters " and substituting the words " , schoolmasters and school teachers "; (c) omitting paragraphs (ix) and (x) and substituting the following paragraphs :- " (ix) Permanent heads within the meaning of the Public ServiceAct1922-1976 and any other persons who hold an office of a position in the public service of Queensland that is equal to or higher than such a permanent head; (x) Persons employed in the Department of Justice; (xa) Persons employed in the Prisons Department or the Probation and Parole Service; (xb) Persons employed in the Police Department;"; (c) in paragraph (xiii), omitting the words " Persons holding any office or employment in or under any department of the public service of Queensland or the Commonwealth, officers " and substituting the word " Officers "; (d) in paragraph (xiv), omitting the words " and clerks ". 3. Amendment of s. 26 . Section 26 of the Principal Act is amended by, in subsection (1)- (a) omitting the word " When " and substituting the words " Subject to this subsection, when "; (b) inserting after the first paragraph the following paragraph:- " Where the person to whom a notice prescribed by section 24 or section 24A of this Act has been directed or who has been summoned to attend as a juror is- (a) a salaried officer of an asylum or hospital; (b) an employee of a Local Authority; or (c) a person holding any office or employment in or under any department of the public service of Queensland, and the manager of the asylum or hospital in question or the clerk of the Local Authority in question or, as the case may be, the permanent head of the department in question certifies that due to the nature of his duties the attendance of that person as a juror would detrimentally affect the service to the public performed by that person the sheriff shall- (i) where such notice has been directed or summons issued pursuant to a jury precept, at any time before the jury precept is returned; or (ii) where such notice has been directed or summons issued pursuant to an order of the Court to summon jurors,
