Juries (Amendment) Ordinance 1983

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to amend the Juries Ordinance 1967
Short title
1. This Ordinance may be cited as the Juries (Amendment) Ordinance
1983}
Principal Ordinance
2. In this Ordinance, "Principal Ordinance" means the Juries Ordinance
1967}
3. After section 51 of the Principal Ordinance the following section is
inserted:
Sheriff shall consider the application and may grant payment to the applicant Payment of juror's expenses
"51 A. (1) Where—
(a)
a person incurs expense during his service as a juror, being expense which he would not have incurred but for that service; and
(b)
that expense was incurred in circumstances arising after the person was sworn as a juror, being circumstances that would have constituted a sufficient cause for the person to be excused attendance on the Court under this Ordinance if they had arisen before he was so sworn,
the person may apply to the Sheriff for payment to the person of an amount
equal to the amount of that expense.
" (2) Where an application is made to the Sheriff under sub-section (1), the

of the whole of the amount of the expense incurred by the applicant or such
lesser amount as the Sheriff considers reasonable.
"(3) A person who is aggrieved by a decision of the Sheriff under sub-section (2) may apply in writing to a Magistrate for a review of the decision.".
Regulations
4. Section 52 of the Principal Ordinance is amended by omitting "the last
preceding section" and substituting "section 51".
