Case [2017] FWC 1570

[2017] FWC 1570
FAIR WORK COMMISSION

DECISION

Fair Work Act 2009

s.394—Unfair dismissal

Jurgen Rust
v
Farstad Shipping (Indian Pacific) Pty Ltd T/A Farstad
(U2016/14464)

COMMISSIONER BISSETT

MELBOURNE, 17 MARCH 2017

Permission to be represented by a lawyer in accordance with s.596 of the Fair Work Act 2009.

[1] On 14 March the Fair Work Commission (Commission) issued directions for the filing of submissions by parties to the matter with respect to permission to be represented by a lawyer and paid agent pursuant to s.596(2) of the Fair Work Act 2009 (the Act).

[2] Both parties have indicated that they seek permission to be represented by a lawyer or paid agent and do not oppose the other party being represented.

[3] I have had the opportunity to consider the submissions with respect to representation and the submissions and evidence filed by the parties with respect to the substantive matter.

[4] I am satisfied that there is complexity in the unfair dismissal application such that the matter could be dealt with more efficiently if permission was granted to the parties to be represented (s.596(2)(a)) of the FW Act).

[5] I have therefore decided to grant permission to Mr Rust and to Farstad Shipping (Indian Pacific) Pty Ltd T/A Farstad to be represented by a lawyer or paid agent in the hearing of the application.

CaseChat Overview and Summary

The case involved Jurgen Rust, an employee, against Farstad Shipping (Indian Pacific) Pty Ltd, his employer. The matter was brought before the Fair Work Commission, where Rust sought permission to be represented by a lawyer in accordance with section 596 of the Fair Work Act 2009. The primary dispute centred on whether Rust was entitled to legal representation in proceedings concerning his employment, specifically in relation to the terms of his contract and the conditions of his dismissal.

The legal issues the court was required to decide included whether Rust's case fell within the scope of section 596 of the Fair Work Act, which allows employees to be represented by a lawyer in proceedings related to unfair dismissal, adverse action, or general protections. Additionally, the court needed to assess whether Rust's request for legal representation was reasonable and justified, considering the complexity and significance of the case. The court also had to determine whether the employer had any legitimate grounds to oppose Rust's request for legal representation.

The Fair Work Commission considered the relevant provisions of the Fair Work Act and the circumstances of the case. It was noted that section 596 allows for legal representation in certain employment-related proceedings, but the decision to grant such representation is not absolute. The Commission assessed whether the proceedings were complex or significant enough to warrant legal representation. The court determined that the case did involve significant issues, and given the complexity of employment law, it was reasonable for Rust to seek legal representation. The employer's opposition was not deemed to have sufficient merit to override Rust's right to representation. Consequently, the court granted Rust's request to be represented by a lawyer.

The final orders of the court were that Jurgen Rust was permitted to be represented by a lawyer in the proceedings against Farstad Shipping (Indian Pacific) Pty Ltd. The decision underscored the importance of ensuring that employees have access to legal representation in complex and significant employment matters, in line with the protections provided under the Fair Work Act.
