Permission to be represented by a lawyer in accordance with s.596 of the Fair Work Act 2009.

[1] On 14 March the Fair Work Commission (Commission) issued directions for the filing of submissions by parties to the matter with respect to permission to be represented by a lawyer and paid agent pursuant to s.596(2) of the Fair Work Act 2009 (the Act).

[2] Both parties have indicated that they seek permission to be represented by a lawyer or paid agent and do not oppose the other party being represented.

[3] I have had the opportunity to consider the submissions with respect to representation and the submissions and evidence filed by the parties with respect to the substantive matter.

[4] I am satisfied that there is complexity in the unfair dismissal application such that the matter could be dealt with more efficiently if permission was granted to the parties to be represented (s.596(2)(a)) of the FW Act).

[5] I have therefore decided to grant permission to Mr Rust and to Farstad Shipping (Indian Pacific) Pty Ltd T/A Farstad to be represented by a lawyer or paid agent in the hearing of the application.
