AN ACT to amend the Judges' Salaries and Pensions

Act, 1950-1972.

[Assented to 25th May, 1973.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Judges' and citation.

Salaries and Pensions Act Amendment Act, 1973.

(2) In this Act the Judges' Salaries and Pensions in Vol. 17 of the

Act, 1950-1972, is referred to as the principal Act.

Section 2

amended. 2. Section 2 of the principal Act is amended by

adding after the interpretation "Judge" the follow-

ing interpretation

"Prior judicial service", in relation to a person who is a Judge or retired Judge, means service as a judge of a court of another State or Territory of the Commonwealth (not being service as a Justice of the Peace or Magistrate) being service prior to the appointment of that person as a Judge; .

Section 6

amended. 3. Section 6 of the principal Act is amended by

adding after subsection (2) the following sub-

section

(2a) For the purposes of this Act, where a Judge had prior judicial service, the period of that service shall be added to, and be deemed to form part of, his period of service as a Judge. .
