AN ACT to amend the Judges' Salaries and Pensions

Act, 1950-1959.

[Assented to 6th October, 1960.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent

of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Judges'

and citation

Salaries and Pensions Act Amendment Act, 1960.

(2)

In this Act the Judges' Salaries and Pensions

Act, 1950-1959, is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Judges' Salaries and Pensions Act, 1950-1960.

Sec. 3

amended.

2. Section three of the principal Act is amended

by repealing the passage, "-1949" in line five.

Sec. 12A

added.

3. The principal Act is amended by adding after

section twelve the following section-

12A. (1) For the purposes of the provisions

of this Act relating to pensions, any person

salary, etc.,

Judge

(a) who has been appointed an acting Judge under the provisions of section eleven of the Supreme Court Act, 1935; and

appointed

Judge.

(b)

who while holding the office under that appointment is appointed a Judge,

shall be deemed to have been appointed a Judge on and from the date of the firstmentioned appointment.

(2) On and from the first day of July, one thousand nine hundred and sixty the provisions of section five of this Act apply to the salary and any adjustment thereto, of a person who before the fourth day of March in that year was so appointed an acting Judge and who while holding that office is appointed a Judge before the thirty-first day of December in that year.

4. Section fourteen of the principal Act is amended by repealing the passage, "-1949" in line six.

5. Section fifteen of the principal Act is amended

by repealing the passage, "-1949" in line three.
