1 . This Act may be cited as the " Judges Retire-

(1) Any judge who on or before the thirty-first day of December, one thousand nine hundred and eighteen, attains or has attained the a<ye of seventy vears shall retire on that day unless he is granted retiring leave, in which case he shall retire on the expiration of such leave. (2)

2 . In this Act, unless the context otherwise re-

quires :—

" Judge " means a judge of the Supreme Court or of the Court of Industrial Arbitration or a Dis- trict Court judge.

(2) Any judge who after the thirty-first day of December, one thousand nine hundred and eighteen, attains the age of seventy years shall retire the day on which he attains that age, unless he is granted retiring leave, in which case he shall retire on the expiration of such leave.

The following provisions shall apply to the pensions
of judges holding office at the commencement of this Act
who retire under this Act :—

(a)

A judge entitled to a pension under the Supreme Court and Circuit Courts Act, 1900, or under section two of the Judges Pensions Amend­ ment Act, 1906, who has not on such retire­ ment served for fifteen years as such judge, shall be entitled to the same pension as if he had so served.

(b)

The present senior judge of the Court of Industrial Arbitration who was appointed by section 13 (2) of the Industrial Arbitration Act, 1912, shall be entitled on retirement, whether or not such retirement is before the thirty-first day of December one thousand nine hundred and eighteen, to the pension of a puisne judge of the Supreme Court retiring under section twelve of the Supreme Court and Circuit Courts Act, 1900.

(c)

Any other judge of the Court of Industrial Arbitration and any judge of a District Court entitled to a pension retiring under this Act, who has not on such retirement served for twenty years as such judge, shall be entitled to the same pension as if he had so served.

5 . Any judge appointed in succession to the present senior judge of the Court of Industrial Arbitration shall be entitled to the pension of a puisne judge of the Supreme Court under section two of the Judges Pensions Amendment Act, 1900. W E S T E R N
