Judges' Pensions Amendment Act 1906 (NSW)

An Act to amend the Supreme Court and Circuit
Courts Act, 1900, and the Distr ict Courts Act,
1901, so far as they relate to the pensions of
Supreme Court Judges and District Court J u d g e s ; and for other purposes. [12th
December, 1906.]
Assembly of New South Wales in Parliament assembled, and by the B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative authority of the same, as follows :— 1. This Act maybe cited as the " Judges ' Pensions Amendment
Act, 1906 ." 2. The operation of subsection one of section twelve of the Supreme Court and Circuit Courts Acts, 1900, is restricted to a chief
justice or puisne judge of the Supreme Court appointed before the
commencement of this Act, and for that purpose the said subsection
is amended by inserting the words " appointed before the commence
ment of this Act'"' after the words " puisne judge."
The following subsections are inserted next after the said
subsection :—
(2) Where a chief justice or puisne judge of the Supreme Court, appointed after the commencement of this Act, has served in such office for fifteen years, he shall on retiring be entitled to an annual pension at the rate of one-half of his salary.
(3) I f such chief justice or puisne judge retires on permanent
subsection is amended by inserting the words " appointed before the
commencement of this A c t " after the word " judge."The disability or infirmity, he shall if he has served in such office for
five years be entitled on retiring to an annual pension at the rate
of twenty one-hundredths of his salary, and at the additional rate of three one-hundreths of his salary for each complete year of his service
after the expiration of the said live years to the date of his retirement,
but so that the rate of his pension shall not exceed one-half of hissalary.
3. The operation of subsection one of section fourteen of the
District Courts Act, 1901, is restricted to district court judges appointed
before the commencement of this Act, and for that purpose the said

subsection :—
(2) Where a district court judge, appointed after the
commencement of this Act, lias served in such office for twenty years he shall on retiring he entitled to an annual pension at the rate of one-
half of his salary.
(3) if such district court judge retires on permanent
disability or infirmity, he shall if he has served in such office for live years he entitled to an annual pension at the rate of twenty one- hundredths of his salary, and at the additional rate of two one- hundredths of his salary for each complete year of his service after the expiration of the said five years to the date of his retirement, but so that the rate of his pension shall not exceed one-half of his salary.
