Pensions of Retired Judges of the Supreme Court Be it therefore WH E R E A S on account of certain doubts which have been enter­tained it is expedient further to regulate and secure the
enacted and declared by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :—
1. There shall in every year be charged upon and payable out of the Consolidated Revenue Fund for Pensions to the several retired Judges of the Supreme Court for the time being such sums of money as they shall respectively be entitled to receive under the conditions and

and according to the salaries and rates established by the Constitution Act assented to by Her Majesty under the Imperial Act eighteenth and nineteenth Victoria chapter fifty-four in that behalf although by such charge and payment the amount limited by Schedule B of that Act may happen to be exceeded Provided that the service entitling to a Pension may be that of combined periods of service as Puisne Judge and Chief Justice as well as that of a single period in one or other capacity Provided also that the Pension shall be at the rate of a Puisne Judge only unless in the case of service as Chief Justice for not less than five years and then at the rate of Chief Justice.

2. This Act shall be styled and may be cited as the " Judges' Pensions Act of 1859."
