  1. The applicant seeks special leave to appeal from the whole of the judgment of the Court of Appeal of the Supreme Court of Western Australia (Buss P, Vaughan JA and Solomon J), allowing an appeal from the judgment of the Supreme Court of Western Australia (Archer J), which in turn allowed an application for review of a decision of the Magistrates Court (Magistrate Hall) pursuant to s 36 of the Magistrates Court Act 2004 (WA), which decision concerned the validity of a prosecution notice in relation to the prosecution of the applicant for an offence against the Work Health and Safety Act 2011 (Cth).

  2. There is no reason to doubt the correctness of the decision of the Court of Appeal of the Supreme Court of Western Australia. Moreover, the proposed appeal does not raise a question of public importance.

  3. Special leave to appeal is refused.
