JETTIES AMENDMENT REGULATIONS (No. 2) 1997

For amendments to 9 June 1997 see 1996 Index to Legislation of Western Australia, Table 4, pp. 157-8, and Gazette 13 May 1997.1

Made by the Governor in Executive Council.

Citation

1.     These regulations may be cited as the Jetties Amendment Regulations

(No. 2) 1997.

Commencement

2.      These regulations come into operation on 1 July 1997.

Principal regulations

3.     In these regulations the Jetties Act Regulations 1940* are referred to as

the principal regulations.

Regulation 25 amended

4.    (1) Regulation 25 (1) (c) of the principal regulations is deleted.

(2) After regulation 25 (1) of the principal regulations the following

subregulation is inserted -

(la) For the purposes of calculating storage charges set out in

Appendix I -

(a) a fraction of a tonne shall be deemed to be a tonne;

(b)

a fraction of a cubic metre shall be deemed to be a cubic metre;

(c) a fraction of a kilolitre shall be deemed to be a kilolitre; and
(d) a part of a week shall be reckoned as one week.

Appendix I repealed and an Appendix substituted

5. Appendix I to the principal regulations is repealed and the following

Appendix is substituted -

carriage of cargo through the port.

2.          Charges for haulage and handling shall be in accordance with the IPLF charge-out rates.

3.          Where the Department has to unstulT or unpack a container, the fee is based on equipment and li'i.l' labour rates for the time involved.

4.           Charges for any unspecified services are dependent on the type of service.

5.          Under regulation 13, the Port Manager may make extra charges for handling packages over one tonne in weight, or of an exceptional shape, or where extra labour is required or unusual risk is involved.

6.          Under regulation 35, the Port Manager may make an extra charge if insufficiently packed goods involve additional labour or risk.

and substituting the following -

4.           A discount of 3.3 % applies for fixed (ie. non-floating) pens.
