Jetties Amendment Regulations 2007
Made by the Lieutenant-Governor and deputy of the Governor in
Executive Council.1. Citation
These regulations are the Jetties Amendment Regulations 2007.
2. Commencement
These regulations come into operation as follows:
(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette; (b) the rest of these regulations — on the later of — (i) the day after that day; or
(ii) 1 July 2007.
3. The regulations amended
The amendments in these regulations are to the Jetties
Regulations 1940*.[* Reprint 5 as at 15 April 2005.

4. Regulation 3 amended
After regulation 3(2) the following subregulation is inserted —
“
(3) For the purposes of calculating fees, charges or dues
prescribed in a schedule —
(a) an amount payable per day is payable for any part of a day; (b) the length of a vessel is its overall length or, if Western Australian Marine Act 1982, its measured length, measured to 2 decimal places.
”.
5. Regulation 11B amended
Regulation 11B(2) is repealed and the following subregulation
is inserted instead —
“
(2) The outwards wharfage rate on fuel oil loaded into a
vessel as bunkers for that vessel’s own use, and on
which an inwards wharfage rate has not been paid, is
set out in Schedule 1A and shall be paid by the supplier
of the oil.”.
6. Regulation 42A inserted
After regulation 42 the following regulation is inserted —
“
42A. Fees for vehicular use of jetty The fees (if any) payable for vehicular use of a jetty
and land adjacent to it are as set out —
(a)
for a jetty at a place outside the Port of Perth, in Schedule 1;

(b) for a jetty in the Port of Perth, in Schedule 2. ”.
7. Regulation 53A inserted
After regulation 53 the following regulation is inserted —
“
53A. Fees for rubbish removal The fees (if any) payable for removal of rubbish by the
Department are as set out —
(a)
for a jetty at a place outside the Port of Perth, in Schedule 1;
(b) for a jetty in the Port of Perth, in Schedule 2. ”.
8. Regulation 94A amended
Regulation 94A is amended by deleting “Schedule 4
Division 1.” and inserting instead —“ Schedule 1. ”.
9. Regulation 94B amended
Regulation 94B is amended by deleting “Schedule 4 Division 2”
and inserting instead —“ Schedule 1 ”.
10. Regulation 94C amended
Regulation 94C is amended by deleting “Schedule 4 Division 3”
and inserting instead —“ Schedule 1 ”.

11. Regulation 94D inserted
After regulation 94C the following regulation is inserted —
“
94D. Waiving fees or charges in emergencies The chief executive officer of the Department may
waive a fee or charge payable under this Division for
the use of a service jetty by a vessel in need of
emergency repair.”.
12. Regulation 96 amended
Regulation 96(a) is amended by inserting after “rendered” —
“ at or in relation to a slip ”.
13. Schedule 1 replaced
Schedule 1 is repealed and the following Schedule is inserted
instead —“ Schedule 1 — Charges, dues and fees at places
outside the Port of Perth
