An Act to provide for the Closing of Portion of a certain Street adjoining the Township of Jeparit and for the Grant of a Lease of the Portion so closed to the Country Fire Brigades Board and for other purposes.
Preamble
WHEREAS the land described in the Schedule hereto forms portion of a street adjoining the township of Jeparit within the shire of Dimboola and known as Broadway:
AND WHEREAS the said street is set out on Crown land:
AND WHEREAS the land described in the said Schedule is not required for the purposes of a street or public highway:
AND WHEREAS it is expedient to provide that the land described in the said Schedule shall cease to form part of the said street in order that the said land may become and be dealt with as unalienated land of the Crown and that a lease thereof may be granted to the Country Fire Brigades Board for the purposes hereinafter specified:
AND WHEREAS the council of the shire of Dimboola has consented to the closing of the said portion of the said street:
BE IT THEREFORE ENACTED by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1.Short title
This Act may be cited as the Jeparit Land Act 1922.
2.Closing of street so far as relates to land described in Schedule
(1)The said recited street to the extent mentioned in the Schedule to this Act is hereby declared to be and the same shall be closed.
(2)(a) The land described in the said Schedule shall cease to form part of the said street;
(b)all rights easements privileges existing or claimed with respect to the said land either in the public or by any body or person whatsoever or whomsoever as incident to any past dedication or supposed dedication thereof or by any past user thereof or by any fiction of law shall cease and determine; and
(c)the said land shall be deemed to be and may be dealt with as unalienated land of the Crown.
3.Power to grant lease of land described in Schedule
(1)Subject to this Act the Governor in Council may pursuant to subdivision 1 of Division 9 of Part I of the Land Act 1915 grant a lease of the said land to the Country Fire Brigades Board for the purposes of a fire station.
(2)Notwithstanding anything in the said subdivision—
(a)such lease shall be subject to the payment of such rent not exceeding One pound per annum as the Governor in Council thinks fit to impose;
(b)the Governor in Council may grant a renewal thereof subject to the payment of the rent aforesaid; and
(c)it shall not be necessary to offer for sale by auction the right to such lease or renewed lease.

SCHEDULE
Land being portion of a street known as Broadway adjoining the township of Jeparit proposed to be excised from the said street and leased to the Country Fire Brigades Board for the purposes of a fire station.
Portion of three chain road (known as Broadway) adjoining the township of Jeparit, shire of Dimboola, parish of Jeparit, county of Borung: Thirty-two perches:
Commencing at a point bearing N. 22º 54' E. one hundred links from the intersection of the east side of John-street and the south side of Broadway, the said east side of John-street bearing N. 67º 6' W. seven chains ninety-four links and eight-tenths of a link from the angle of the original Government road formed by the bearings S. 67º 6' E. and N. 43º 48' E.; bounded thence by lines bearing respectively N. 22º 54' E. one chain, S. 67º 6' E. two chains, S. 22º 54' W. one chain and N. 67º 6' W. two chains to the commencing point.
