1. By reason of s 58 of the Bankruptcy Act 1966 (Cth), the applicant for special leave to appeal to this Court did not have standing to challenge the rights of the first to third respondents asserted in the proceedings below. The decision of the Court of Appeal of the Supreme Court of Victoria is clearly correct. The application should be dismissed.

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
