s1 2 s4 James Cook University of North Queensland No. 193, 1997 (The Academic Board) Amendment (No. 1) ˙ Short title 1. This statute may be cited as the James Cook University of North Queensland (The Academic Board) Amendment Statute (No. 1) 1997 . ˙ Commencement 2. This statute commences on 30 June 1997. ˙ Statute amended 3. This statute amends the James Cook University of North Queensland (Statute No. 4—The Academic Board) Statute . 1 ˙ Replacement of ss 1–7 4. Sections 1 to 7— omit, insert— ˙ Definitions 1. In this statute— “additional member” means a member under section 4. “board” means the academic board of the university. “certified agreement” means a certified agreement under the Workplace Relations Act 1996 (Cwlth), whether under that Act before or after the commencement of the Workplace Relations and Other Legislation Amendment Act 1996 (Cwlth), for 2 (a) the university’s teaching and research staff, and staff of the university whose instrument of appointment by the council states they are members of the academic staff; or 1 The statute appears in the gazette of 18 June 1988 at page 1365. 2 Under the Workplace Relations and Other Legislation Amendment Act 1996 (Cwlth), schedule 19, part 1, item 1, the short title of the Industrial Relations Act 1988 (Cwlth) was amended and the title WorkplaceRelationsAct1996 substituted.
s4 3 s4 James Cook University of North Queensland No. 193, 1997 (The Academic Board) Amendment (No. 1) (b) staff of the university other than staff mentioned in paragraph (a). “chairperson” means the chairperson of the board. “deputy chairperson” means the deputy chairperson of the board. “eligible member” means a member, other than an official member or additional member. “member” means a member of the board. “official member” means each of the following— (a) vice-chancellor of the university; (b) deputy vice-chancellor of the university; (c) pro-vice-chancellors of the university; (d) vice-president (administration) of the university; (e) executive deans of the university; (f) director, postgraduate studies of the university; (g) director, Centre for Aboriginal and Torres Strait Islander Participation, Research and Development of the university. ˙ Role of board 2.(1) The board is a committee of the council and the principal academic body of the university. (2) The board is to— (a) advise the council about teaching, scholarship and research matters concerning the university; and (b) formulate proposals for the academic policies of the university; and (c) monitor the academic activities of the university’s faculties; and (d) promote and encourage scholarship and research at the university.
s4 4 s4 James Cook University of North Queensland No. 193, 1997 (The Academic Board) Amendment (No. 1) ˙ Constitution of board 3.(1) The board consists of the following— (a) the official members; (b) 5 representatives of each faculty of the university, elected under the rules; (c) 4 students of the university, appointed by the union under the rules; (d) 1 member of the university’s staff in the Academic Support Division, appointed by the university’s pro-vice-chancellor (academic support). (2) Also, the board consists of— (a) persons nominated, from time to time, as members under section 4; and (b) another person elected or appointed as a member under section 6(2). 3 ˙ Additional board members under certified agreement 4.(1) This section applies if— (a) a certified agreement provides the board must consist of a person nominated as a member under the agreement; and (b) a person is nominated as a member under the agreement. (2) The person is a member. ˙ Election of chairperson and deputy chairperson and related matters 5.(1) Under the rules, the official members, eligible members and any additional members must elect— (a) an eligible member to be the chairperson; and 3 Under section 6(2), a person is elected or appointed a member after an eligible member becomes the chairperson.

(2) The deputy chairperson must act as chairperson— (a) during a vacancy in the office of chairperson; and (b) during all periods when the chairperson— (i) is absent from the university; or (ii) is granted leave of absence by the university’s vice-chancellor; or (iii) cannot temporarily perform the functions of the office. (3) If the person who holds the position of chairperson or deputy chairperson becomes an official member, the person is taken to have resigned as the chairperson or deputy chairperson on the day the person becomes an official member. ˙ Membership of board after elections 6.(1) This section applies after the chairperson and deputy chairperson are elected. (2) If the chairperson was originally a member— (a) as a representative of a faculty of the university—the board also consists of another representative of the same faculty, elected under the rules; or (b) as a student of the university—the board also consists of another student, appointed by the union under the rules; or (c) as a member of the university’s staff in the university’s Academic Support Division—the board also consists of another member of the university’s staff in the Academic Support Division, appointed by the university’s pro-vice-chancellor (academic support). ˙ Number of board meetings a year 7. The board must meet at least 4 times a year.’.
s5 6 s5 James Cook University of North Queensland No. 193, 1997 (The Academic Board) Amendment (No. 1) ˙ Replacement of ss 10–14 5. Sections 10 to 14— omit, insert— ˙ Duties of board 10. The board must— (a) consider and report on matters referred to it by the council or the university’s vice-chancellor; and (b) as soon as practicable after each meeting of the board, submit a written report about the meeting to the council; and (c) perform other duties approved by the council. ˙ Committees 11.(1) The board may establish committees for effectively and efficiently performing its functions. (2) The board may appoint persons, including persons who are not members, as members of the committees. (3) The board may decide matters about a committee, including, for example, the way a committee must conduct meetings. ˙ Transitional provision for chairperson and deputy chairperson 12.(1) In this section— “commencement” means the commencement of this section. “current chairperson” means the person who held the position of chairperson immediately before the commencement. “current deputy chairperson” means the person who held the position of deputy chairperson immediately before the commencement. (2) The purpose of this section is to provide for the current chairperson and current deputy chairperson to continue as members, and as the chairperson and deputy chairperson, after the commencement. (3) The current chairperson is taken to be a member, and to have been

(4) The current deputy chairperson is taken to be— (a) a member as a representative of the Faculty of Law and Education, elected under the rules, until 28 February 1998; and (b) elected under section 5(1)(b) as the deputy chairperson, until 28 February 1998. (5) Because the deputy chairperson is taken to be a member as a representative of the Faculty of Law and Education— (a) the board, immediately after the commencement, is to consist of only 4 representatives of the Faculty of Law and Education; and (b) the rules for the election of representatives of faculties do not apply to the election of the 4 representatives of the Faculty of Law and Education, to the extent that only 1 of the 4 persons elected need be a head of a school within the faculty.
